1. Copyright, Intellectual Property, and Usage Rights
Ownership of Work: AVC Photography LLC retains sole ownership and full copyright of all artwork, images, and photographs captured or created.
Licensing vs. Sale: All images are licensed to the client, not sold. Clients are granted a non-exclusive license to use the final images for personal purposes only (e.g., displaying in a home or private office).
Restrictions on Use: Images may not be reproduced, altered, resold, or distributed for commercial purposes. Any modifications or alterations to the finished work require prior written consent from Alyssia Howard.
Social Media & Public Attribution: For any public display or social media sharing, clients must credit AVC Photography LLC as the photographer/artist.
2. Creative Discretion & Portfolio Rights
Artistic Control: AVC Photography LLC reserves full creative judgment and discretion regarding composition, lighting, style, and editing of all final delivered work.
Promotional Use: The studio reserves the right to use any finished work, images, or artwork for portfolio building, marketing, and self-promotion across official websites and social media platforms.
3. Payment Terms, Fees, and Cancellations
Service Term Policy Details Upfront Retainer A 50% non-refundable deposit is required upfront to secure bookings for Portraits, Headshots, and Special Events. The remaining balance is due immediately upon completion of services.
Cancellations & No-Shows If a client cancels or fails to attend a scheduled appointment, the upfront fee is strictly non-refundable.
Travel Expenses Additional travel fees will apply and vary based on the session location.
Rush Fees & Additional Editing Requests for expedited delivery or extended editing outside the standard package will be billed at $25 per hour.
4. Delivery, Shipping, and Limitation of Liability
Shipping Policy: Physical orders are fulfilled via UPS Ground and dispatched in a timely manner.
Limitation of Liability: AVC Photography LLC is not responsible for project delays, delivery interruptions, or data loss caused by factors outside its reasonable control. This includes, but is not limited to, shipping carrier delays, equipment malfunction, or technical data failure.
5. Acceptance of Terms
By booking a session, commissioning services, or purchasing items from the online shop, the client acknowledges and accepts all terms and conditions outlined above.
